The attorney in this position will be part of the Marriott Law Department and will work in the Gurgaon office. The attorney will have a dual reporting line to Vice President & Senior Counsel in the Gurgaon office and Vice President & Senior Counsel for Compliance in the Hong Kong office. The position will provide legal services in the area of compliance and lodging operations for the South Asia region.
The attorney will be required to develop an understanding of Marriott's internal policy’s, its standards of operations and development techniques and practices. The attorney will be required to provide legal assistance to business partners, on-property and above property multi discipline leads, staff departments, above and on-property managers, as well as coordinate with attorneys and paralegals within Asia Pacific and externally with local counsel’s, vendors and consultants.
Specific Job Summary and Expected Contributions - Compliance
  •  Support the objectives set by the Audit Committee established by the Board and Directors and the Company’s Legal and Ethical Steering Committee (LESC) by working closely with the Law Department’s Regional Compliance Officers and Internal Audit Department;
  • Ensure strong coordination and cooperation are achieved between the Law Department and other corporate departments with compliance obligations such as Internal Investigations, the Internal Audit Department, the Corporate Secretary’s Office, Government Affairs, and the Finance organization to ensure that roles and responsibilities are understood in matters of legal and ethical compliance;
  • Take responsibility for managing compliance in various South Asian jurisdictions including India, Bangladesh, Nepal, Sri Lanka, Maldives and Bhutan as well as ensuring adherence to the Company’s high ethical standards;
  • Work with designated business leaders with compliance responsibility and other compliance offices within the Company with respect to multi-faceted training and awareness programs that focus on key areas of compliance risk and seek to ensure that all appropriate employees and management are cognizant of their legal duties under applicable laws and corporate policies;
  • Collaborate with the appropriate business leaders to develop practical, effective processes and controls to ensure compliance through oversight and monitoring;
  • Support the Continent’s and Regions Legal and Ethical Compliance Counsel’s (LECC) and serve as a liaison to the Company’s LESC; 
  • Facilitate the implementation of the Company’s global and regional compliance policies and procedures in South Asia and enhance the South Asia’s compliance posture through ongoing risk assessments, relevant training and communication programs, and the initiation of effective remedial measures as necessary recognizing the critical importance of the U.S. Federal Sentencing Guidelines’ elements of an effective compliance program;
  • Maintain the highest levels of coordination with Marriott’s Chief Internal Audit Executive and Global and Regional Compliance Counsel with respect to all matters pertaining to the compliance program;
  • Provide legal advice and tactical direction to auditors, investigators and human resource managers in internal investigations;
  • Participate in remediation decisions and in proposing corrective action, including proposing individual disciplinary action as required in serious cases of non-compliance;
  • Provide training, legal oversight and expertise relative to the management of an effective compliance program at all levels of the South Asia’s operations to sustain the Company’s confidence in local compliance and to ensure vigilance against non-compliance with a strong focus on the US FCPA, UK Anti-Bribery Act, OFAC, anti-trust laws and data protection laws in South Asia;
  • Monitor current and evolving statutes, regulations, and case law related to areas of critical or strategic importance to enterprise-wide legal and ethical compliance program in global business environment; 
  • Ensure that accurate and timely reporting of compliance events and concerns is furnished to the appropriate executives in the Company’s LESC, Law Department and Internal Audit;
  • Support and lead investigations of suspected or alleged non-compliance utilizing internal and external investigative and audit resources by (1) ensuring investigations are handled promptly, fairly and resolved consistently, (2) ensuring matters appropriate for investigation receive timely follow up, and (3) providing guidance on or leading investigations.
  • Anticipate, monitor and track the current and changing legal environment and how it affects business including statutes, regulations, and case law related to areas of critical or strategic importance to the company.
Specific Job Summary and Expected Contributions – Lodging Operations
  •  Provide legal assistance to BMSC, Finance, Accounting, Revenue Management, Owner Franchise Relations, Global Initiatives and Lodging Services group;
  • Assist in any litigation or disputes at or above property;
  • Assist in trademark matters such as infringements, filings, renewals in the South Asia region. Coordinate with local trademark counsel on these aspects;
  • Draft and negotiate agreements for 3rd party spa’s or any F&B outlets, vendor or service contracts, group sales contracts, crew and corporate rate contracts,
  • Provide legal advice on guest accidents or other general matters arising at or above the hotels.
  • Provide general assistance to the team as and when needed
  • Perform other duties and special projects as requested.
    Candidate Profile
  • Excellent academic records with a law degree from a top Indian law school;
  • Minimum of four years post-qualification legal experience in a well-regarded Indian law firm or in-house position with a major multi-national company with a focus on compliance ;
  • Fluent in both spoken and written English and Hindi;
  • Outstanding analytical, writing and oral communication skills; 
  • Proven project management experience, strong drafting and problem-solving skills, excellent organizational skills, as well as the ability to work well under pressure while producing a high volume of accurate work;
  • Constructive approach to dealing with conflict, and ability to influence and achieve successful results without damaging relationships;
  • Ability to expeditiously identify and assess issues and provide legally sound recommendations consistent with good business practices and reason;
  • Ability to work independently and take ownership of, and effectively resolve, problems;
  • Excellent client service and communications skills (oral and written);
  • Strong interpersonal and consultative skills; ability to interact effectively and work diplomatically with individuals at all levels;
  • Ability to think strategically and provide leadership when needed;
  • Ability to expeditiously identify and assess issues and provide legally sound recommendations consistent with good business practices and reason;
  • Ability to assess and balance risks and understand the commercial drivers of projects; and
  • Strong interpersonal skills and ability to interact effectively, work diplomatically and foster relationships with individuals at all levels.
