Position Summary

 

 

The labour employment attorney in this position will be part of the Marriott Law Department and will work in the India market reporting to the VP and Senior Counsel - Labour and Employment in APAC continent office.

    

 

The attorney will work on labour employment cases and projects in locations throughout South Asia area.  The attorney will develop in depth understanding of Marriott’s personnel policies and practices to advise a broad array of cases including human resources documentations, hotel personnel deployment, labour employment statutory compliance, workplace investigations, personnel dispute resolution, and labour relations.  Travel will be required. 

    

 

The attorney can be based in Mumbai or Gurgaon.  Depending on candidate profile, other business location such as Bangalore can be considered. 

 

 

 

Specific Job Summary and Expected Contributions

    

 

Primary responsibilities of this attorney will include:

 

 

  • Drafting and advising on employment agreements, secondment agreements, contract labour agreements, equity compensation agreements, restrictive covenants, auxiliary HR forms and agreements, and employment handbook;

     
  • Advising HR on compensation and benefits legal issues including wages, hours, social security, leave, incentives, and severance plans;

     
  • Advising HR and senior management on workplace statutory compliances, such as POSH committees, crèche facilities, and CLRA compliance, as well as HR legal compliance audits;

     
  • Providing legal trainings to Directors of Human Resources and business leaders;

     
  • Partnership with HR to carry out workplace investigations, ICC hearings, internal grievance procedures, and domestic inquiries, and disciplinary actions;

     
  • Providing preliminary legal guidance on unionization, labour relations, CSR, and human rights;

  • Candidate Profile  
    • Excellent academic records with a law degree;   
    • 3-5 years of post-qualification legal experience in labour employment practices in India, with full-fledged human resources business exposure to confidently advise clients from a statutory as well as a practical and strategic perspective;   
    • Active Bar membership / practicing certificate;   
    • Outstanding analytical, writing, communication, and client-servicing skills;   
    • Proven project management experience, strong drafting and problem-solving skills, excellent organizational skills, as well as the ability to work well under pressure while producing a high volume of accurate work;  
    • Constructive approach to dealing with human resources related crises and sensitive terminations, and ability to influence and achieve successful results;   
    • Ability to expeditiously identify and assess issues and provide legally sound recommendations consistent with good business practices and reason;     
    • Ability to work independently and take ownership of, and effectively resolve, problems; 
    • Strong interpersonal and consultative skills; ability to interact effectively and work diplomatically with individuals at all levels;
