The Community you will join:

Airbnb is looking for a Senior Commercial Counsel to join our growing Legal team. The ideal candidate will have 8-10 years of hands-on experience drafting, reviewing and negotiating a range of complex commercial agreements and advising on related matters, with a focus on customer verification (trust and validation), customer services, and related privacy and data processing requirements. 

The difference you will make:

As a key member of the Airbnb North America Commercial Legal team, you will be responsible for supporting the inbound commercial contracting needs of a range of Airbnb business teams, primarily focused on vendors providing: 1) SAAS-based customer verification technologies and related services, 2) customer support services, either directly or through Airbnb-managed systems, and customer service-related technologies, and 3) other types of agreements and negotiations involving processing of significant customer data by third parties. Your ability to analyze, communicate and propose effective solutions to risk scenarios is critical to your success in this role.

You must be able to balance legal and business risk with the needs of the business, have deal management experience, negotiation skills, and demonstrate an ability to thrive in a demanding, fast-paced environment. We’re looking for a highly adaptable and collaborative person who can operate with minimal oversight. You must be able to communicate effectively and efficiently with peers on other Legal teams and in business units, and with senior business and legal leadership. With an expected heavy workload, you must be able to prioritize matters while progressing all assigned responsibilities, and handle ambiguity and rapidly shifting priorities with flexibility, patience, and poise.

A typical day:

  • Draft, review and negotiate a range of complex commercial agreements including SaaS and managed services, software license, master services, technology implementation, data platform and data processing agreements.
  • Advise business clients, Commercial Legal team members, other Legal team members (such as in Litigation, Privacy and Payments), Legal leadership and business units leadership on all issues related to specific areas of responsibility, and on strategies for effecting optimal outcomes for Airbnb on agreements and related negotiations. 
  • Be well-versed in global privacy laws, and independently handle review and negotiation of data processing agreements, including resolution of basic issues and providing advice to Airbnb business units; on more complex data privacy-related issues, work closely with Airbnb’s Privacy Legal team on risk analysis and issue resolution strategies.
  • When requested, support the Commercial Legal team’s Lead counsel and other Commercial Legal team members on large and complex deal negotiations, including risk analysis and negotiation strategies, and with direct drafting input.
  • Identify process improvements and initiate action with the Commercial Legal team and with other Legal team members to develop and support implementation of solutions.
  • Help educate business clients on Commercial Legal’s approach to risk analysis, on negotiation strategies, and on Airbnb policies related to privacy and data security.
  • Help shape the continuous improvement of Airbnb agreement templates and actively engage in development of guidance to other Legal teams, business unit partners, and the Airbnb Procurement team.


Your expertise:

  • JD and a minimum of 8 years of relevant experience in a law firm and/or in-house legal department. In-house experience at a multinational, technology, travel or consumer-facing company is strongly preferred
  • Member of the California Bar (in good standing) or eligible to register as California Registered In-House Counsel
  • Demonstrated experience leading deal negotiations
  • A working knowledge of issues related to consumer-oriented online platforms
  • An interest in and passion for Airbnb’s mission
  • Strong academic credentials
  • Excellent written and verbal communication skills
  • Proactive, adaptable, self-directed person who can, with poise and patience, prioritize and manage multiple projects and recalibrate in response to shifting priorities, process change, and risk tolerance
  • High level of integrity, professionalism, intellectual curiosity, sense of humor, and desire and passion to learn and grow


How we'll take care of you:

Our job titles may span more than one career level. The starting base pay for this role is between $195,000 and $245,000. The actual base pay is dependent upon many factors, such as: training, transferable skills, work experience, business needs and market demands. The base pay range is subject to change and may be modified in the future. This role may also be eligible for bonus, equity, benefits, and Employee Travel Credits.  

Your Location:

This position is US - Remote Eligible. The role may include occasional work at an Airbnb office or attendance at offsites, as agreed to with your manager. Airbnb,Inc. can employ in  states where we have registered entities. Currently, employees can not be located in: Alaska, Indiana, Nebraska, North Dakota, Ohio, South Dakota, Wisconsin, Alabama, Mississippi, Oklahoma, Delaware and Rhode Island.
